3. The website is a catalogue, not an online shop
The website is a product catalogue and quotation tool. It is important that you understand the following:
- We do not display prices on the website and we do not accept payment through the website.
- Adding a product to the quote basket and submitting a quote request does not create a sale, a reservation of stock or any binding agreement.
- A quote request is an invitation for us to quote. Any quotation we issue in response is an offer, which you may accept or decline.
- A sale is concluded only when we accept your order in writing, or when goods are supplied and paid for at our trade counter or on an approved account.
Because no transaction is concluded on the website, the seven day cooling off right in section 44 of the Electronic Communications and Transactions Act does not apply to purchases made from us. Your rights under the Consumer Protection Act 68 of 2008 are not affected, where that Act applies to you.
4. Quotations
Unless the quotation itself states otherwise:
- A quotation is valid for 14 days from the date of issue.
- Prices quoted are exclusive of VAT, delivery and any other charges, unless expressly stated.
- Prices are subject to change without notice, including as a result of exchange rate movement, supplier price increases or changes in duties and levies.
- A quotation is subject to stock availability at the time your order is accepted.
- A quotation is confidential and is issued for your use only.
5. Product information, images and specifications
We take reasonable care to describe our products accurately. However:
- Product descriptions, specifications, dimensions, capacities and performance figures are supplied by manufacturers and suppliers and are indicative rather than guaranteed.
- Product images are for illustration. Colour, finish, packaging, bracketry and included accessories may differ from the image shown. Where an image is marked as representative, it is a clean stand in photograph of the product type and the item supplied may not look identical to it.
- Manufacturers may change specifications, revisions or model codes without notice to us.
- Errors and omissions are excepted. We reserve the right to correct any error on the website, in a quotation or in an order confirmation.
If a specific specification is critical to your installation, please confirm it with us in writing before you order. You remain responsible for satisfying yourself that a product is suitable for your intended application and that it is installed in accordance with the manufacturer's instructions and any applicable South African standard or regulation.
6. Trade customers and installers
Much of our range is intended for supply to and installation by trained installers. Certain products, including electric fence energisers, gate and garage automation and mains connected equipment, must be installed by a suitably qualified and, where required by law, registered person. Where a certificate of compliance is required, it is the responsibility of the installer and the property owner to obtain it.
Nothing on the website constitutes installation, design or engineering advice.
7. Third party brands and trademarks
We are an independent multi brand distributor. All manufacturer names, brand names, logos, product names and model codes referred to on the website are the property of their respective owners and are used for identification and descriptive purposes only.
Reference to a brand on the website indicates that we supply or have supplied that product. It does not imply that we are an authorised agent, appointed distributor or approved service centre for that brand, unless we state so expressly.
8. Intellectual property
All content on the website, including text, layout, design, graphics, photographs, logos and the compilation of the product catalogue, is owned by us or licensed to us and is protected by South African and international intellectual property law.
You may view the website and print or download extracts for your own internal business use. You may not otherwise copy, reproduce, republish, distribute, adapt, frame, scrape, mine or commercially exploit any part of the website without our prior written permission.
9. Acceptable use
You agree not to:
- use the website for any unlawful purpose or in a way that breaches any applicable law;
- introduce any virus, trojan, worm, logic bomb or other harmful code;
- attempt to gain unauthorised access to the website, the server on which it is hosted or any connected system;
- use any automated system to scrape, harvest or copy content or contact details from the website;
- submit false, misleading or fraudulent information through any form on the website;
- use contact details obtained from the website to send unsolicited commercial communications.
Unauthorised access to or interference with the website may constitute an offence under Chapter 13 of the Electronic Communications and Transactions Act 25 of 2002 and the Cybercrimes Act 19 of 2020.
10. Availability of the website
We do not warrant that the website will be available uninterrupted or free of error, that defects will be corrected, or that the website or the server that makes it available are free of viruses or other harmful components. We may suspend, withdraw or restrict all or part of the website without notice.
11. Links to other websites
The website may contain links to third party websites, including manufacturer sites and datasheets. Those links are provided for convenience only. We do not control and are not responsible for the content, products, services or privacy practices of any linked site.
12. Limitation of liability
To the maximum extent permitted by law:
- the website and its content are provided "as is" and "as available", without warranty of any kind, whether express or implied;
- we are not liable for any indirect, incidental, special, punitive or consequential loss, including loss of profit, loss of business, loss of data or loss of goodwill, arising from your use of or inability to use the website or from reliance on any information on it;
- our total liability arising from your use of the website is limited to R1 000 or the amount you have paid us in respect of the relevant transaction, whichever is the greater.
Nothing in these terms limits or excludes any liability that cannot lawfully be limited or excluded, including liability under sections 60 and 61 of the Consumer Protection Act 68 of 2008 where that Act applies.
13. Indemnity
You indemnify us and hold us harmless against any claim, loss, damage, cost or expense, including reasonable legal costs, arising from your breach of these terms or your unlawful or negligent use of the website.
14. Privacy and personal information
Our collection and use of personal information is governed by our Privacy Policy and our Cookie Policy, which form part of these terms. Our PAIA Manual is also available.
15. Electronic communications
You consent to receiving communications from us electronically. Any communication we send to the email address you provide is deemed to have been received on the day it was sent, unless the sender is notified that it was not delivered.
16. Governing law and jurisdiction
These terms are governed by the law of the Republic of South Africa. You consent to the jurisdiction of the Magistrate's Court having jurisdiction in respect of any dispute arising from these terms or your use of the website, without prejudice to our right to institute proceedings in any other competent court.
17. Complaints and dispute resolution
If you have a complaint, please contact us first at sales@securitycity.co.za or 011 422 6001 so that we can try to resolve it directly.
If your complaint is not resolved to your satisfaction and the Consumer Protection Act applies to you, you may refer it to the Consumer Goods and Services Ombud at www.cgso.org.za, or to the National Consumer Commission.
18. General
- Severability. If any provision of these terms is found to be invalid or unenforceable, that provision is severed and the remaining provisions continue in full force.
- No waiver. Our failure to enforce any provision does not amount to a waiver of that provision or of our right to enforce it later.
- Whole agreement. These terms, together with the Privacy Policy, Cookie Policy and any written quotation or order confirmation, constitute the whole agreement between us in relation to your use of the website.
- Headings. Headings are for convenience only and do not affect interpretation.
